The agreement
These Terms of Service (the “Terms”) are an agreement between MenLiving (“MenLiving”, “we”, “us”) and you. They cover the products and services MenLiving makes available — gatherings, circles, articles, the podcast, the online community, and this website (together, the “Services”). By using the Services you agree to these Terms. If you do not agree, you are not authorized to use the Services.
What you confirm by using the Services
- You have the legal right to agree to these Terms, and you will follow them.
- You are not a minor where you live, or you have a parent’s or guardian’s permission.
- You will not use bots or scripts to access the Services.
- You will not use the Services for anything illegal or unauthorized.
- Your use will comply with the laws and regulations that apply to you.
If you provide false or incomplete information, we may suspend or end your use of the Services. We may edit or remove content you post, and we may decline or end anyone’s participation, at our discretion.
Privacy and community agreements
Your use of the Services is also governed by our privacy policy and, inside the online community and every gathering, by the community agreements each member accepts. Both are part of these Terms.
Peer connection, not therapy
MenLiving is a peer-led organization. It does not offer therapy and is not a replacement for it. A facilitator leads and holds each gathering; facilitators are not trained mental health professionals or providers. We work to keep what is shared in a gathering private, but we cannot guarantee it, so be thoughtful about what you share.
Whatever is said in a gathering about privacy or confidentiality, there are exceptions:
- If a facilitator reasonably believes that disclosing something shared in a gathering is necessary to prevent harm to a person, he may disclose it, sharing only the minimum he believes essential.
- MenLiving cannot control what other attendees share, and is not liable for the results of any disclosure they make.
If you are grappling with thoughts of harming yourself or others, please reach a licensed mental health professional.
Other people
We do not run background or identity checks on the people who use the Services and do not ask about their histories. We encourage respect, but MenLiving is not responsible for the conduct of any participant, on or off the Services. Use your own judgment and caution in every interaction, and particularly if you decide to meet someone in person.
Giving
Gifts and donations to MenLiving are voluntary, are processed by GiveWP and Stripe, and are governed by their terms as well as these. A recurring gift can be changed or cancelled at any time from the donor dashboard or by writing to todd@menliving.org. Giving is never a condition of attending any open gathering.
Intellectual property
We respect the intellectual property of others and expect the same. Except as these Terms allow, you may not use any part of the Services, including its content and MenLiving’s name and marks, for a commercial purpose without our prior written permission. Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to download or print a copy of any part of the website you have properly reached, for your personal, non-commercial use.
Third-party sites and content
The Services link to other websites and include content from them — the online community, the giving forms, the podcast host, and articles and resources. We do not review or control those sites and are not responsible for their content, opinions, privacy practices or policies; linking to them is not an endorsement. Once you leave our website, these Terms no longer apply and theirs do. Any purchase you make through a third-party site is between you and that party.
Warranties and liability
We provide the Services “as is”, without warranty of any kind, and disclaim all warranties, express or implied. Neither MenLiving, including its affiliates, nor anyone involved in creating or delivering the Services will be liable for incidental, special, exemplary or consequential damages resulting from any use or interruption of the Services. To the maximum extent the law allows, you agree to release, defend (at our option), indemnify and hold harmless MenLiving, its employees and volunteers from any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or your improper use of the Services.
Governing law and venue
These Terms, and every claim or dispute arising from or related to them, are governed by the laws of the State of Illinois, without reference to choice-of-law rules. The federal and state courts in DuPage County, Illinois, and the courts that hear appeals from them, are the only courts with jurisdiction and venue over disputes under these Terms. Both parties and their successors waive trial by jury on any issue arising under or connected with these Terms.
Changes
We may change these Terms by posting an updated version on this page; the date at the top changes with it. Continuing to use the Services after a change means you accept the new Terms. Questions about them go to todd@menliving.org.
